The Friends of Darius Pearce

The friends of Darius Pearce are delighted to announce that thanks to your kind contributions we have been able to secure Jeremy Moore on a fixed fee basis to take Darius' appeals to the Judicial Committee of the Privy Council and the European Court of Human Rights.

With the prosecution against Darius still ongoing after more than five years, it has been a long road to get the case out of the jurisdiction of Jersey but we now have a lawyer who is willing to argue against the authorities.

Jeremy Moore, is notable as the solicitor who previously successfully assisted Barry George to overturn the wrongful conviction for the murder of Jill Dando after serving eight years in prison. Read the Guardian coverage of the case. 

Darius has a number of avenues of appeal; largely that he was not given a fair hearing for various reasons including evidence unlawfully obtained, false arrest, improper search warrants, a failure to recognise the separate legal identity of a corporation.

The Appeal was not a fair hearing as the key evidence was only adduced by the Attorney General after the hearing had taken place and because the Bailiff sat as the President of the Court of Appeal when his own decisions were the subject of that appeal.

We are confident that in due course the office of Bailiff will be subject to having its powers broken up into more than one office. It cannot be mere conincidence that the Bailiff announced his impending retirement less than one week after we bought Jeremy Moore onboard.
